Tree Maintenance and Removal

Before undertaking any work on a tree located near a street, ensure that it is indeed on your property. You cannot perform any work on trees within the right-of-way, including pruning.

Justification for Tree Removal

When applying for a permit, tree removal must be justified by one of the following reasons to be authorized:

  • The tree is dead or diseased, and no treatment can ensure its survival beyond 5 years.
  • The trunk of the tree is located less than 3 meters (9'-10") from the foundation of the main building or an in-ground pool (does not apply to an accessory building or an above-ground pool).
  • The tree is inhibiting the growth of another tree (does not apply to the lawn, a hedge, or a shrub).
  • The tree poses a danger to people's safety.
  • The tree has been damaged by strong winds, freezing rain, etc.
  • The structural integrity of the tree is compromised by a structural deficiency (a leaning trunk does not necessarily mean the tree's strength is affected).
  • The tree obstructs a construction project (shed, pool, etc.). If the construction can be located elsewhere on the property, tree removal may be refused.
  • The tree must be felled for the execution of public works (e.g., Hydro-Québec).
  • Tree removal is allowed when there are at least two other trees located in the same yard as the tree to be felled (for example, 3 trees located in the backyard, not 3 trees for the entire property—see diagrams).

Note that the permit application may be denied if pruning works can correct the situation.

Replacement of Felled Trees

The felled tree must be replaced if, after felling, the minimum number of trees required on the property is not respected, or if there are no trees in the front and/or back yard.

A financial assistance program for tree planting is available for residential properties.

Tree Pruning: Tree pruning must be done in a manner that does not harm the tree's health.

Excessive pruning (topping) that risks damaging the tree is considered tree removal. This technique can only be authorized if a tree removal permit is obtained beforehand.

Electrical Wires: Caution!

Always entrust pruning or felling work near electrical wires to professionals.

When planting a tree near electrical wires, make sure to maintain a sufficient distance that accounts for the tree's future growth.

Unjustified Tree Removal

The following situations do not justify tree removal, even if they pose an inconvenience:

  • The tree loses its leaves, fruits, attracts insects, blocks light, etc.
  • The tree is too close to the fence, shed, above-ground pool, etc.
  • The tree's roots cause pavement slabs or asphalt to lift or crack.
